Distance Sales Agreement

This Distance Sales Agreement (the “Agreement”) has been concluded electronically, in accordance with the provisions of the Turkish Law No. 6502 on Consumer Protection and the Distance Contracts Regulation, between the SELLER/INTERMEDIARY whose details are set out below and the CONSUMER, regarding a hotel accommodation reservation made through the Bedoka Platform.

This Agreement is separately approved at the payment step for each reservation; the reservation is not completed without approval.

1. The Parties

1.2. CONSUMER (Guest)

The Consumer’s full name, address, email, phone and invoice details are entered by the consumer at the reservation and payment step and are deemed an integral part of this Agreement. The Consumer accepts that the information provided is accurate and complete.

2. Subject of the Agreement

The subject of this Agreement is the purchase of a hotel accommodation reservationservice at the accommodation facility (hotel) selected by the Consumer through the Bedoka Platform, for the specified date(s), and the determination of the parties’ rights and obligations relating to this service under Law No. 6502 and the Distance Contracts Regulation.

Bedoka acts as an intermediary in this transaction; the actual provision of the accommodation service is carried out by the relevant hotel. The characteristics of the service subject to the reservation (hotel name, room type, stay dates, number of guests, board type, etc.) are clearly shown at the reservation step on the Platform.

3. Price and Method of Payment

The total price of the service subject to the reservation, including all taxes, is clearly stated in the reservation summary before payment. The Consumer may make payment by one of the following methods:

  • Credit / debit card: Through the secure payment infrastructure (with 3D Secure where necessary).
  • Wire / EFT transfer: Payment to the account details notified in the reservation confirmation, within the specified period.

Upon confirmation of payment, the reservation is finalized and a confirmation/voucher is sent to the Consumer by email. Unless otherwise stated, prices apply in the selected currency.

4. Performance and Delivery

Performance of the service takes place by the provision of accommodation at the hotel selected by the Consumer, on the dates specified in the reservation. The reservation confirmation (voucher) is sent electronically to the email address provided by the Consumer. The Consumer is obliged to present identity and reservation information during check-in at the hotel.

5. Right of Withdrawal and Its Exception

Under Article 15 of the Distance Contracts Regulation concerning the exceptions to the right of withdrawal; the right of withdrawal cannot be exercised in contracts relating to accommodation that must be performed on a specific date or period. For this reason, there is no 14-day right of withdrawal for hotel reservations made for specific accommodation date(s).

Nevertheless, the cancellation and refund rules of the rate you select (flexible / non-refundable) apply. For cancellation requests, the deduction table and refund processes, please review our Cancellation and Refund Conditions. The fact that the right of withdrawal is an exception does not eliminate your cancellation/refund rights arising from the contract or the rate.

6. Declarations and Obligations of the Consumer

  • The Consumer is responsible for the accuracy and completeness of the reservation and payment information.
  • The Consumer accepts that they were informed, prior to payment, about the essential characteristics of the service, the total price and the cancellation conditions.
  • The Consumer accepts that they read this Agreement and the Cancellation/Refund Conditions and approved them at the payment step.

7. Complaint and Objection Authority

For disputes arising from this Agreement, the Consumer may apply to the Consumer Arbitration Committee of their place of residence or of the place where the transaction was carried out, within the monetary limits announced each year by the Ministry of Trade; and to the Consumer Courts for disputes above these limits. 8. Entry into Force

This Agreement enters into force and becomes valid between the parties upon the Consumer’s electronic approval at the payment step through the Platform. A copy of the Agreement is sent to the Consumer with the reservation confirmation email.
